Terms and Conditions of membership in Shyami Elite Matrimony from Shyami Matrimony
This document is an electronic record in terms of the Information Technology Act, 2000, and Rules there under pertaining to electronic records as applicable and amended. This electronic record is generated by a computer system and does not require any physical or digital signatures.
This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021 that require publishing the rules and regulations, privacy policy, and the terms and conditions for access or usage of www.shyamielitematrimony.com (the "Website").
Please read the following terms and conditions very carefully as your use of the Website and associated SEM Services (as defined below) is subject to your acceptance of and compliance with the following terms and conditions including the applicable policies which are incorporated herein by way of reference and as amended from time to time (the "Terms and conditions").
ACCESSING, BROWSING OR OTHERWISE USING THE WEBSITE or SEM Services INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS HEREIN, SO PLEASE READ THE TERMS AND CONDITIONS CAREFULLY BEFORE PROCEEDING. By impliedly or expressly accepting these Terms and Conditions of use of website, EM Services, You also accept and agree that you have read, understood and are bound by these Terms and conditions, regardless of how you/SEM member subscribe to or use the SEM Services. If you do not want to be bound by the Terms and Conditions, you must not use the EM Website or the SEM Services.
In these Terms, references to "You" or "User" or "SEM member" shall mean the end user accessing the SEM Website/SEM services, its contents or using the SEM Services offered. "SEM Services" means a collective reference to the Shyami Elite Matrimony service provided by ShyamiMatrimony.com
Scope
Shyami Elite Matrimony [SEM] is personalized match making services of ShyamiMatrimony.com, which is valid for a period of the applicable package chosen by you (and visible on this website) from the date of taking the SEM package and as detailed in Clause 4 herein below ("Tenure"). SEM may at its sole discretion extend the SEM services beyond Tenure, however if such SEM services are provided based on additional payment to be made by the registered SEM member, if any. Membership to SEM is exclusively through invitation. SEM is an endeavour to help you find your dream life partner (prospect) through the process of searching, shortlisting and contacting prospects, during the Tenure. Upon availing our SEM service a dedicated Relationship Manager ("RM") will be assigned to you during the Tenure of SEM Service. Based on your set partner preference RM shall assist you in processing your request for lawful marriage partner search through the database of members listed on the consortium of portals owned by ShyamiMatrimony.com. SEM Membership is guided by the terms and conditions mentioned herein below. By using or accessing the SEM Services, you agree to be bound by all the terms and conditions ("Agreement"):

3. Registration
(A) If you intend to register with SEM, after enquiries of SEM services, then SEM shall send you a physical subscription form /online subscription form (as applicable) ('SEM Subscription Form'), for keying in your essential details and filling in the blanks. We expect that you would complete the SEM subscription form with fairness and honesty while furnishing your personal information. You would appreciate that efficient and effective match making by SEM (as part of SEM services) depend upon yourself furnishing true, accurate, current and complete information, photo(s) etc. SEM expect you to read the relevant column before entering in the details or selecting the option available or providing/uploading your photo(s). You are requested not to enter details of the profile in field other than the applicable field (including mentioning id's of other platforms/websites/ applications/irrelevant information) or repeating your details in another fields, after filling them once in the relevant fields or providing other persons photographs. You further undertake that you alone shall be responsible or liable for any information provided to SEM by you. In order to serve you better if SEM requires additional details you agree to provide the same to SEM. SEM shall reproduce the SEM Subscription Form details on "AS IS AS AVAILABLE" basis to other members (i.e. members listed on the consortium of portals owned by matrimony.com limited / SEM database etc.), and SEM members shall be solely liable for the information given by such EM member.
(B) If at any point of time SEM comes to know or has reasons to believe that any information provided by you for registration or otherwise is found to be untrue, inaccurate, or incomplete then EM shall have full right to suspend or terminate your membership and forfeit the amount paid by you towards SEM membership fee and refuse to SEM service to such SEM member thereafter without any notice.
4. Tenure
Tenure of the SEM service shall dependent upon the package offered by SEM or for any tenure which may be introduced from time to time by SEM and chosen by you after appropriate payment.
5. Mode of Payment
(A) Payment made by cash/cheque / Net Banking / Debit / Credit Card would be in accordance with the prevailing RBI guidelines. Activation of SEM service shall be subject to the realization of the said payment. In case of dishonor of Cheque/demand draft; you shall be liable to pay the applicable bank's cheque/DD bouncing charges. Further, SEM service to your account will be deactivated/suspended until you settle the value of the payment and applicable bank charges in cash.
(B) SEM may use third-party payment gateways for the collection of credit/debit cards or other payment instruments. In case of such payment gateway failure, the same would be communicated to the EM member by the payment gateway provider. SEM shall not be responsible for Extra currency/conversion charges/deductions/error issues from the payment gateway. In the case of failed online transactions, which result in no services, SEM offers no guarantees whatsoever for the accuracy or timeliness of the refunds reaching the Member's card/bank accounts through the payment gateways.
(C) Member who has opted for any SEM package in which the SEM member needs to pay on success, then such EM member shall pay the balance amount on finalization of your marriage.
6. Role and Responsibility of SEM
(A) Upon enrollment into the SEM services, EM shall assign a Relationship Manager (RM) to you, who will help you with the process of match making search during the tenure of SEM service.
(B) SEM will endeavour to provide profile(s) as per your set partner preference subject to availability of profile in the data base of the consortium of portals owned by Matrimony.com Limited. The SEM service will be carried out only during normal working hours of SEM i.e., 09:30 am to 06:00 pm Monday to Saturday excluding Sunday and public holidays for Indian Members and for Non-Resident Indian Members the working hours shall be from 09:30 am to 06:00 pm (Indian Standard Time) [Monday] to [Saturday] excluding Sunday and public holidays in India. RM entrusted with your profile can contact the SEM member at least 2 times in a week to update the SEM member's on profile management.
(C) The SEM is under no obligation to furnish any definite number of profiles, if there are none available, which are corresponding to the partner preference set by you.
(D) EM shall shortlist and initiate contact with prospects only if age difference of SEM member is as follows:
(E) Similarly, For SEM members whose marital status Divorced / Widowed / Separated / Annulled, such SEM member shall shortlist and initiate contact with prospects who are Divorced / Widowed / Separated / Annulled only. SEM will not get in touch with prospects with different marital status.
(F) Any prospect suggestions made by RM are solely based on your partner preference.
(G) SEM shall source profiles for you/SEM member, as per your partner preference being set, from the consortium of portals owned by MCL (including Shyamielitematrimony.com, and Shyamimatrimony.com), subject to the availability of profiles.
(H) A member who has opted for any SEM package in which the SEM member needs to pay on success such SEM Members profile will be retained in the SEM database until the member communicates finalization of his / her marriage or intention not to retain in the database expressly in writing.
(I) At SEM we value your privacy. You hereby grant your consent for using, analysing, storing and sharing your profile/information to prospects, service providers as per the Privacy Policy of SEM.
(J) SEM's responsibility is restricted only to offer match making profiles to SEM members based on the partner preference set by SEM members. SEM cannot guarantee or assume responsibility for any specific results from the use of the data available from the consortium of websites/portal's from ShyamiMatrimony.com and / or the SEM service. In case partner preference is modified by SEM member, then the SEM service search results may also undergo corresponding changes.
(K) Shortlisted profile information link shared with SEM members will be active only for 10 days from the shared date.
(L) SEM doesn't do any background verification of the profiles uploaded in our consortium of Websites. SEM shall share profile information of the prospect based on information updated in our databases by the EM member/ respective profile owner.
(M) SEM does not give any implied or explicit guarantee or warranty of marriage or alliance, by you choosing to register on our website and using SEM services and, for positive response from prospects and does not guarantee marriage within the service period.
(N) As a part of SEM service, SEM will share you all the prospect profiles as per your partner preference set. Post your interest in any of such shared prospect profiles, SEM will share your profile with the concerned prospect for their Interest Confirmation and upon confirmation received from the prospect, SEM shall arrange for a meeting between you and the prospect (with/without your/prospects family members/friends joining in). The venue of such meeting shall be duly intimated to you by RM.
(O) Providing additional information like horoscope, photo, proof of education, property details, reason for Divorced / Widowed / Separated / Annulled, amount received as alimony is completely depended on decision of prospects. SEM cannot promise or guarantee 100% sharing of such information.
(P) SEM strictly does not allow SEM members to have any kind of conversation with prospects on subjects, which are illegal as per the law of the land (Example: Dowry).

8 Medium of Communication to EM Members
(A) SEM member hereby consents for receiving communication including promotional communications through any medium of communications such as Emails and /or SMS/Calls/Chat from consortium of portals owned by MCL or their alliance partners.
(B) EM may contact the SEM member through any of the above media to share the profile of the prospect by way of internal messages / links. SEM member confirms that the mobile number submitted to it for verification or alternative number if any provided, is not registered with the Do Not Disturb / National Customer Preference Register and they shall not initiate any complaint. SEM Member further confirms that even if SEM Member is registered with the telecom service provider under the category Do Not Disturb / National Customer Preference Register the calls from SEM either to the verified mobile number or alternative number if any provided shall not be treated as promotional calls.
(C) You agree to receive calls from Relationship Manager of Shyami Elite Matrimony for contacting you as a shortlisted profile for their registered members, even after the SEM service Tenure is over.

10. Privacy of Membership
(A) SEM member is committed to protecting the member's privacy and shall take all efforts to protect any personal data provided to us by reasonable security safeguards against such risks as loss or unauthorised use, destruction, modification or disclosure of data etc.
(B) Although we will strive to safeguard the confidentiality of your personally identifiable information, transmissions made by means of the Internet cannot be made absolutely secure. SEM member understand and agree that SEM will have no liability for disclosure of your information due to errors in transmission or unauthorized acts of third parties.
(C) You also agree to keep the profiles shared with you as confidential, to avoid any misuse of the profile so shared by SEM with you.
(D) Please read and comprehend our Privacy Policy, which also governs your visit to SEM website or for use of SEM services, to understand our practices.
(E) SEM members agree that if their profile(s) is listed on the MCL consortium of websites, and if their profile is crawled and indexed by search engines, where MCL consortium of websites and its network does not have any control over the search engines behaviour. In such an event SEM shall not be responsible for such activities of other search engines/third party websites.
(F) You agree that, when you use third party services through Website, you hereby grant SEM the right to share your information needed for providing such third party services to you or in relation to processing your information for office use of SEM/its payment gateway and/or such third party service providers.
(G) You confirm that you have read and understood the Privacy Policy of SEM
11. Renewal
Before the expiry of the Tenure of the SEM package, you have the option to renew the subscription by paying the renewal fee for the SEM package opted for.
12. Subscription Fee for the chosen SEM Package
You shall appreciate that, to serve you with matching profiles, lot of time and energy of the RM is spend in assisting you in searching the profiles as per the partner preference set by you, etc. Therefore, SEM Membership fees paid, by way of registration / membership / renewal fee, for EM services are treated as non - transferable and non-refundable. Payment once made cannot be assigned to any person/party or adjusted towards any other product or packages provided by the Company.
13. Third Party website
(A) SEM member understand and agree that SEM may allow third parties to put up advertisements on the SEM Website, and SEM does not control the contents of such third party advertisement on the SEM Website. Third party websites to which links are given on Website are not governed by these Terms and conditions and all such third party websites are governed by their own terms and conditions for use and privacy policy, and in case of conflict, the terms and conditions of the third party website shall prevail. The MCL does not in any manner whatsoever authenticate, endorse, verify or certify these third party websites or any contents therein. Please note that a user shall click on links to third party websites at his / her sole risk and responsibility.
(B) The SEM members agrees and understands that SEM may also allow third parties to provide EM members services on the website like horoscope matching etc., and SEM may also collect the payment for such third party services from you, and SEM in this regard can have revenue sharing arrangement with the such third party, however in no event shall SEM be liable to you for such third party services.
(C) SEM reserves the right to add/delete/alter/modify/suspend any or all the SEM Services at any time as it may deem fit, without notice. The SEM members are expected to see the change to the terms of SEM services on the Website regularly.
14. Disclaimer
(A) Your use of the SEM Services or any content provided to you by SEM is at your own risk. YOU UNDERSTAND AND AGREE THAT THE EM SERVICES ARE PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS. WITHOUT LIMITING THE FOREGOING, TO THE FULL EXTENT PERMITTED BY LAW, EM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SEM does not warrant that the Website, its servers, or e-mail sent from SEM are free of viruses or other harmful components. SEM will not be liable for any damages of any kind arising from the use of this SEM Website, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
(B) SEM does not give any implied or explicit guarantee or warranty of marriage or alliance by you choosing to use SEM services.
(C) Notwithstanding anything contrary contained anywhere, under no circumstances, SEM shall be held responsible or liable whatsoever or howsoever, arising out of, relating to or connected with:
